      When a Jakursmu user sends you messages, the message may include a web beacon to determine the number of people who open them. When you click on a link, Jakursmu or its user may record this individual response to customize special offerings to you. Web beacons collect only limited information, such as a cookie identifier, time and date of a page being viewed, and a description of the page on which the web beacon resides (the URL). Web beacons can be refused. If you do not wish to receive web beacons via email, you will need to disable HTML images or refuse HTML (select Text only) emails via your email software.

        Information Collection / Opt-Out

      Jakursmu provides you (the Jakursmu customer) the tools and resources to collect your subscribers' contact information on an opt-in basis. Subscribers, on the other hand, have the ability to opt out of your distribution lists easily and at any time. Subscribers can grant or revoke your ability to view and export their contact information by logging into the Subscription Management and unchecking the box labeled: "Allow access to my contact information."

        Online Sign-up

      Jakursmu allows you to collect email addresses, instant message screen names, phone numbers, and other custom data when subscribers opt in to join your distribution list(s) via an online sign-up page powered by Jakursmu. When joining a distribution list, we will ask subscribers for personal information such as their name, phone number, IM screen name, and email address. The information they provide and the information Jakursmu obtains about them may be used to:
      • Provide subscribers with products and services they request.
      • To anticipate and resolve problems and conflicts with our products and services.
      • For verification and authentication purposes in regards to requests or changes of any personal information or data related.
      • For other purposes communicated to them at the time they provide or authorize the use of their information. All subscribers have the ability to unsubscribe or change their personal subscription settings at any time. You should allow and inform your subscribers to unsubscribe by:

        Importing Contact Information

      You agree to import, add, edit, access or otherwise use only lists for which all listed parties have opted in to receive correspondence from you ("Permission-Based Lists") in connection with your use of the service. You hereby covenant that you shall not use any other lists in connection with your use of the service. In the event that you import or add a subscriber with phone numbers, you must be able to provide tangible proof upon request that the subscriber being imported or added has given prior express written consent to be added to your lists and to receive solicitation messages from you. Written consent may be granted when a subscriber is clearly and fully notified of the collection of their contact information and agrees in writing that he or she may be contacted through their collected contact information. Prior express written consent can be obtained in hand written form or via email, website form, text message, or other methods in compliance with the E-SIGN Act. You will have to obtain prior express written consent from the recipient of your solicitation messages, even if you previously had a business relationship with the recipient. In addition, TCPA has revised a rule regarding text or voice solicitation messages. Click here for more information. You should not assume a preexisting relationship to be a substitute for explicit permission to import corresponding contact information into Jakursmu system. Nor should you send messages without explicit permission. For example, if your customer disclosed a mobile number in a normal course of business but did not specifically express permission to receive your message, you cannot send messages to the number. If it is discovered that you have been delivering any type of message to recipients who have not granted you permission, you will be held fully accountable for your actions and are subject to any and all legal actions that result from such violations including class action suits whether you use our standard user interface or API.

        Mobile Keyword

      In addition to Online Sign-up pages, you can also collect mobile phone numbers when subscribers text your mobile keyword (that you create) to Jakursmu's shared short code. By texting your mobile keyword, subscribers are opting in their mobiles phone numbers to join your distribution list(s). Also, when subscribers text in your mobile keyword, they are giving prior express written consent so you can view and access their mobile numbers. This allows you to send solicitation messages to the subscribers. Subscribers can remove their mobile phone numbers from your database at any time by replying to any text message they receive from Jakursmu with "STOP". They can also change permission for you to view (or export) their contact information by unchecking "Allow access to my contact information." box while they are signed into the Subscription Management page.

        Sharing and Usage / Exporting

      Jakursmu does not share, sell, or rent any contact information with any party. You are not allowed to share your subscribers' contact info with any third party for any reason. However, Jakursmu may use or disclose information, including your personal information and your subscribers' contact information, under the following very limited circumstances:
      • To provide you with products and services requested by you or your subscribers.
      • To anticipate and resolve problems and conflicts with our products and services.
      • For verification and authentication purposes in regards to requests or changes of any personal information or data related.

    Jakursmu's Anti-SPAM Policy

    Jakursmu has a NO TOLERANCE anti-SPAM policy. Any account, Multi-Channel, Automation, Multi-Department / Location or Enterprise Level, found to be using Jakursmu for spam will be suspended without notice. A violations analysis review will be conducted, a probationary period MAY or MAY NOT be granted. Termination will be the result of Any account, Multi-Channel, Automation, Multi-Department / Location or Enterprise Level, found to be using Jakursmu for blatant, excessive and repeated spamming. In ANY case of Jakursmu's Anti-Spam Policy a NO REFUND stance will be taken.

  • Unsubscribe - All emails and instant messages sent from Jakursmu offers an "unsubscribe link" which allows contacts to be removed from future voice messages, instant messages and emails. Jakursmu automatically updates your company contact lists by removing those users who have requested to be removed from the associated voice, instant message and email list. When any user replies to any mobile text with the "STOP" command, this user is removed from any future text messages from your company. Users of voice broadcasts can opt out of voice messages by entering the number "7" to be removed from future voice messages. Users can "re-enter" any of your company campaigns any time an attractive offer is acted upon by the user.

Any Jakursmu Personal, Private, Business, Multi-Channel, Automation, Multi-Department / Location or Enterprise Level user sending any form of spam will be suspended / terminated from using Jakursmu’s service and may be subject to legal action by Jakursmu, government authorities, or the recipients of your messages. Cloaking Jakursmu's monitoring system or the delivery of spam messages through the system establishes a clear and serious spam violation.
    All mobile messages: SMS texts messages, voice messages, instant messages, MMS video messages, social messages and email messages, delivered by the Jakursmu mobile messaging service, are delivered with an essential “unsubscribe” link and or instructions allowing recipients the options to “opt-out” or to be removed from receiving future messages. For instance, mobile text messages must include STOP instructions – text STOP – to stop receiving future messages. Voice messages must include STOP instructions – press 7 – to stop receiving future messages. Any alterations or omissions to this opt-out policy will result in a non refundable termination to the abusers account.
    Exactly - What is Spam? Unwanted messages - texts, voice, instant messages, video and email – which can include commercial and private messages - that are deemed annoying and time-consuming. Also any unwanted digital message sent to mobile phones or other mobile devices that can be or may be considered intrusive and costly. Two laws – the Telephone Consumer Protection Act (TCPA) and the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act – address spam.
    Unwanted Texts and the Telephone Consumer Protection Act The TCPA and the FCC’s rules ban many text messages sent to a mobile phone using an autodialer. These texts are banned unless (1) you previously gave consent to receive the message or (2) the message is sent for emergency purposes. This ban applies even if you have not placed your mobile phone number on the national Do-Not-Call list of numbers telemarketers must not call.
    Unwanted Texts and Email under the CAN-SPAM Act The CAN-SPAM Act supplements the consumer protections provided by the TCPA. The CAN-SPAM law bans unwanted email messages sent to your mobile phone if they are “commercial messages.” (Email messages can sometimes appear as texts on your mobile phone, depending on how they’re addressed.) The CAN-SPAM Act defines commercial messages as those that primarily advertise or promote a commercial product or service. The FCC’s ban does not cover “transactional or relationship” messages -- that is, notices to facilitate a transaction you have already agreed to -- for example, messages that provide information about your existing account or warranty information about a product you’ve purchased.     • How to establish consent? Users receiving your company messages have been informed of the collection and use of any contact information and has consented, as required by law, prior to receiving your company messages. Consent may be in the form of handwriting, email, web form, text message, or other methods in compliance with the E-SIGN Act. New consent must be obtained from the recipient of your company messages, even if you previously had a business relationship with the recipient. Consent IS NOT obtained by a user purchasing a product or service from your company or partakes in an event, meeting, conference or general activity. Nor do you have consent if a person "Likes" or "Follows" your business on any social channel. If you require a user to confirm that they opt in to your system but have not received a response from the user, then consent has NOT been established.     What establishes prior express written consent? Telephone Consumer Protection Act 47 U.S.C. § 227 (5) The term “unsolicited advertisement” means any material advertising the commercial availability or quality of any property, goods, or services which is transmitted to any person without that person's prior express invitation or permission, in writing or otherwise. Written consent may be granted by the user via, but not limited to, a web form submission, short code response, consent response to SMS text, MMS coupon or voice message.

  • Consent / agreement can be established when a user responds to a web form submission, short code response, consent response to SMS text, MMS coupon or voice message. This authorizes the seller to deliver telemarketing messages to a designated phone number using an automatic telephone dialing system.
  • Customers or consumers are not obligated or committing to enter into your company marketing campaign when a product or service is purchased from your company.

  • At Jakursmu's discretion, any Personal, Private, Business, Multi-Channel, Automation, Multi-Department / Location or Enterprise Level account will be suspended without a refund or credit if the account knowingly or unknowingly contributes to spam or violates federal, state, local or carrier laws or rules. In addition, in Jakursmu's defense, Jakursmu may be required to assist the parties claiming damages from your actions related to spam.
  • All entities using the Jakursmu mobile marketing system agree to not access or use ANY third party mailing lists for email addresses, instant message screen names, or phone numbers, or otherwise prepare or distribute unsolicited messages in connection with the Jakursmu service
  • All entities using the Jakursmu mobile marketing system agree to import, add, edit, access or use only lists for which all listed parties have opted in to receive correspondence from you ("Permission-Based Lists"). You hereby covenant that you shall not use any other lists in connection with your use of the service. In addition, it is prohibited to import phone numbers without tangible proof of the subscribers' explicit consent to receive messages. Doing so will deny you of this feature or be subjected to a stringent qualification process to comply with various local and federal laws.   • It is the responsibility of those using the Jakursmu Mobile Marketing System to keep current, update and maintain all distribution lists. It is also understood and agreed that each mobile message delivered by the Jakursmu system may not reach the intended recipient. For instance, delivering a message to a specific distribution list may result in the message being received by an unintended recipient as a result of a distribution list change. Therefore it is solely the responsibility of those using the Jakursmu Mobile Marketing System to keep current, update and maintain their company distribution lists.
  • All entities using the Jakursmu mobile marketing system will comply with and continuously uphold the Privacy Policy, including any and all future changes, updates and modifications.
  • All entities using the Jakursmu mobile marketing system agree to full public honest and ethical organizational identification transparency. Avoiding any form of identity deception be it: not limited to offerings, pricing, availability, including any form of messaging with list recipients.
  • Any entity may terminate this Agreement at any time by notifying Jakursmu’s Customer Support. Account Non use or inactivity will not automatically terminate an account, where the account owner remains liable for ALL service fees until the account is canceled. You understand and agree that Jakursmu will make NO REFUND of any fees paid regardless of whether the service has or has not been used or logged into.
  • Jakursmu may terminate this Agreement or service, disable the account or deactivate the account in each case at any time with or without cause, and with or without notice. Jakursmu shall have no liability to the account owner or any third party due to such termination or action. Jakursmu may delete any archived data within 30 days after the date of termination. If any account has NOT been cancelled and is classified as inactive by Jakursmu for at least 90 days, Jakursmu has the right to permanently delete all account data with no ability to recover such data at its discretion.     Unique Identification Data Collection

    Unique Identification Data Collection, owned by a person aka subscriber, is obtained by the Jakursmu mobile marketing system on a volunteer, opt-in understanding, which is gathered in various methods.

  • Jakursmu – Constant Messaging users may gather unique identification data such as: first and last name, screen name, address, phone number, email address or any custom unique identification data when a subscriber volunteers this information to the Jakursmu system. Once a new subscriber voluntarily enters the Jakursmu system, verification will be sent to the email, mobile phone or instant message screen name that has been submitted.     • How can I build my Company database?

    • Why is the disclosure field required when creating a keyword?

      In compliance to MMA regulations - when an individual opts into a distribution list - the advertiser must provide an estimate of how many messages an individual will receive in a given month.

        This will not prevent you to send messages above this threshold value.

    • Why is my mobile keyword not working?

      a. When creating a mobile keyword, the very last step would be selecting the frequency at which the auto-response message is sent to the contact after he/she texts the keyword to the short code. There are three options you can choose from in this step:

        i. Only once per mobile number: If a number is already on the distribution list that is attached to this keyword, they will not receive the auto-response message. .

        ii. Only once every (hour, day, week, month, year): A customer can only receive the auto-response message every hour, day, week, month, or year depending on which one you choose. For example, if you select every hour and the customer texts the keyword twice within one hour, they will only receive the auto-response message once.

        iii. Every time: No matter how many times the customer texts the keyword, they will get the auto-response message every time.

      b. The reason a keyword might not be working when you test it is because the last step was set to “Only once per mobile number”. Again, if the number is already in the distribution list, you will not receive the auto-response message. We suggest that if you are running a test, select “Every time” in the last step. Once testing is complete, you can go back into your keyword and change the selection to “Only once per mobile number”.

    • Why are two messages sent out when my customer texts the keyword, and can I remove the REPLY STOP to cancel?

      When someone texts a keyword for the first time, there are two messages that are sent to their phone: the "Welcome standard data rates may apply" message and the auto-response message which you created. The “Welcome standard data rates may apply” message is a requirement mandated by the MMA guidelines and our contract with our supported phone carriers. However, due to this requirement, it will not cost you any text credits. In addition - the “REPLY STOP to cancel” is required and therefore must appear on every message that is sent to a contact.

      Delivering / Sending Messages
    • Will subscribers receive multiple messages if they are listed in more than one of my distribution lists?

      No. Our system recognizes if the same contact has been added to multiple distribution lists. If you send a message to two or more distribution lists that contain repeat contacts, those contacts will receive only ONE message.

    • Why do some of my messages fail?

        i. The text message was sent to a landline. In some cases, consumers may have provided you with their landline number, which is not capable of receiving messages. Therefore, to help resolve this situation, we highly recommend that all customers use our filter landlines feature which is located under the “Manage Contacts” section. This feature will filter out any landline numbers from the list of phone numbers you upload to the site. .

        ii. Carriers are blocking third party messaging from being sent to the phone number. To help resolve this particular situation, the contact must call their phone carrier and ask to have third party messaging be sent to their phone.

        iii. The phone carrier is unsupported. Although we do support all major phone carriers and some smaller ones like Boost and Metro PC, there are some instances where the carrier does not support third party messaging. The same is also true for prepaid phones.

    • What is the cost difference between SMS and MMS?

      Because of the file size that is being sent, there is a cost difference in terms of text credits between SMS and MMS. A regular SMS text blast, which includes simple plain text and up to 160 characters will cost 1 text credit per mobile number it is sent to. A MMS text blast, which includes long text messages (160 characters and more), picture, and video, will cost 6 text credits per mobile number sent to.
